How to apply for UK spouse visa refusal appeal to the administrative review?

 If the person has applied for the U.K. visa for spouse and the same is refused or rejected by the home office authorities then the person has an option of UK spouse visa refusal appeal through which the decision of the home office can be challenged and asked for an administrative review to again verify the details and review the application. This administrative review takes the original and fair decision at the end. 


However, some of the visa types are eligible for the UK settlement visa appeal or some are not eligible for it. In other simple words, we can say that with some of the visa types the UK spouse visa refusal appeal can be asked or requested and with some visa types the UK spouse visa refusal appeal can not be asked for the administrative review.


Here is the complete process that is followed when a person applies for the uk settlement visa appeal:


1. The PBS or point based system is being followed for the tier 1, tier 2, tier 4, and the tier 5 visa types to get the decision fairly. In this point based system the documents, certificates, background of the person, application submitted by the person etc. are given some points at each stage. And at last, as per the points, the refusal appeal is being judged. The more the points the more easily the visa will be passed or approved.


2. All the documents and certificates provided by the person are being scrutinized again and checked again by the administrative review.


The person or an individual has a full right to challenge the refusal of the visa by home office authorities by filing a refusal appeal. The refusal appeal file can be asked for so many visa types such as the spouse visa refusal, the ILR or indefinite leave to remain in the U.K. application refusal, the residency card of the U.K. refisal, or the application of the permanent residence of the U.K.


If the person feels that the refusal or rejected application by the home office is wrong or misinterpreted then he or she has 14 calendar days to file an appeal for the same to the administrative review and if the person is outside the U.K. then he has 28 calendar days to file an appeal for the same.
